Safety Disclaimer & Limitation of Liability

HazSight is a decision-support aid, not a substitute for professional emergency response. In an emergency, do not approach the hazard to get a better photo. Move to safety, call 9-1-1 (or your local emergency number), and follow the instructions of trained first responders. Never delay calling for help in order to use this App.
1. Nature of the service
HazSight uses an automated, on-device artificial-intelligence model to estimate the identity of hazardous-materials placards and to surface reference information derived from the 2024 Emergency Response Guidebook. AI output is probabilistic and may be incomplete, delayed, or incorrect. Placards may be damaged, obscured, mislabeled, or absent, and the App may misidentify them or fail to identify them. HazSight is intended only to support situational awareness by trained responders and the public — it is not an authoritative determination of any hazard.
2. Not professional or emergency advice
HazSight does not provide professional, emergency, medical, legal, or safety advice. It is not a replacement for: official emergency services; qualified hazardous-materials responders; the official printed or authoritative Emergency Response Guidebook; on-scene command; or any legally required procedure. Always defer to official responders and authoritative sources.
3. Assumption of risk
Hazardous-materials incidents are inherently dangerous. You understand and accept that any decision you make is your own responsibility, and you assume all risk arising from your use of, or reliance on, HazSight. Do not place yourself or others in danger to operate the App.
4. No warranty
To the maximum extent permitted by law, HazSight and all related content are provided "AS IS" and "AS AVAILABLE," without warranties or conditions of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement. Dromos Inc. does not warrant that HazSight will be accurate, error-free, uninterrupted, or available when needed.
5. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Dromos Inc., its officers, employees, contributors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of life, personal injury, property damage, loss of data, loss of profits, or other losses, arising out of or relating to your use of, inability to use, or reliance on HazSight, even if advised of the possibility of such damages, whether based in contract, tort, strict liability, or any other theory. To the extent liability cannot be excluded, it shall be limited to the greatest extent permitted by law, and in no event shall the total aggregate liability of Dromos Inc. exceed one hundred U.S. dollars (US$100). HazSight is provided free of charge, and this allocation of risk is a fundamental basis of the bargain.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, the above exclusions and limitations apply to the fullest extent permitted by law, and nothing in this document limits liability that cannot lawfully be limited.
6. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Dromos Inc. from and against any claims, liabilities, damages, losses, and expenses arising out of your use or misuse of HazSight or your violation of the Terms of Service.
7. Relationship to the Terms
This Safety Disclaimer & Limitation of Liability is incorporated into and forms part of the HazSight Terms of Service. Governing law and venue are as stated there (State of Texas, USA).
